A very common situation that leads to a dispute arising from a real estate deal involves issues regarding disclosure.  A disclosure based dispute typically arises following the closing date, after the buyer takes possession, and when the buyer discovers a patent defect or a latent defect, that was undisclosed during negotiations.  Allegations of undisclosed defects often involve a water leak, a pest infestation, a faulty fixture, among other things.
